Employee Trusts – Perpetuity Periods

Employee trusts are, in common with all other non-charitable settlements, subject to the ‘rules against perpetuity’. One of the key recommendations of the Nuttall Review of Employee Ownership was that the law should be changed so as to permit certain employee trusts to exist in perpetuity. This proposal has now been rejected by the Department for Business Innovation & Skills on the grounds that they have thus far received insufficient evidence that such a fundamental change to the existing trust laws is sought or justified.
